Terms of Use

Effective Date: April 1, 2026

1. Acceptance of Terms

By accessing or using the Tooele County Republican Party website ("the Site"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you may not use the Site.

To create an account, you must affirmatively accept these Terms of Use and our Privacy Policy. We may update these terms from time to time. When we make material changes, we will notify you through the Site and ask you to review and accept the updated terms before continuing to use authenticated features.


2. Eligibility

  • Account creation — You must be at least 18 years of age to create an account on the Site.
  • Donations — To make a political contribution, you must be a United States citizen or lawful permanent resident, at least 18 years of age, and making the contribution with your own funds. Federal contractors are prohibited from making contributions to political committees.
  • Banned users — If your account has been suspended or banned, you may not create a new account or access restricted features without prior authorization from site administrators.

3. Account Responsibilities

When you create an account, you agree to:

  • Provide accurate and truthful information during registration and keep your profile information current.
  • Maintain the security of your login credentials. You are responsible for all activity that occurs under your account.
  • Notify us promptly if you become aware of any unauthorized use of your account. Contact us through our Contact page.
  • Maintain only one account per person. Creating multiple accounts to circumvent bans, manipulate systems, or misrepresent your identity is prohibited.
  • Enable multi-factor authentication when required by your account role. Administrative and staff roles require MFA for security.

4. FEC Disclaimer

Paid for by the Tooele County Republican Party. Not authorized by any candidate or candidate's committee.

Contributions to the Tooele County Republican Party are not tax-deductible as charitable contributions for federal income tax purposes.


5. Donation Terms

5.1 Eligibility

By making a donation, you certify that:

  • You are a United States citizen or lawful permanent resident.
  • You are at least 18 years of age.
  • This contribution is made from your own funds and is not being made using funds provided by another person or entity.
  • You are not a federal contractor (prohibited from contributing under 52 U.S.C. § 30119).
  • You are not a foreign national without permanent resident status (prohibited under 52 U.S.C. § 30121).

5.2 Contribution Limits

All contributions are subject to federal contribution limits established by the Federal Election Commission. It is your responsibility to ensure your contributions do not exceed applicable limits. If we determine that a contribution exceeds legal limits, we will refund the excess amount.

5.3 FEC Reporting and Disclosure

Federal law requires us to collect and report the name, mailing address, occupation, and employer of individuals whose contributions exceed $200 in aggregate during an election cycle. This information is reported to the Federal Election Commission and becomes part of the public record (52 U.S.C. § 30104).

The "anonymous" option on our donation form controls only how your name appears on our website. It does not affect mandatory FEC reporting.

5.4 Refund Policy

Contributions are generally non-refundable. We may issue refunds in the following circumstances:

  • Duplicate charges — If you are charged more than once for the same donation due to a processing issue.
  • Excess contributions — If a contribution exceeds federal limits and must be returned.
  • Fraud — If a donation was made fraudulently or without the account holder's authorization.

Refund requests must be submitted within 60 days of the transaction by contacting us through our Contact page.

5.5 Recurring Donations

If you set up a recurring (monthly) donation, your payment method will be charged automatically each month for the amount you specified. You may cancel a recurring donation at any time through your account dashboard or by contacting us. Cancellation takes effect before the next scheduled charge.

5.6 Payment Processing

Donations are processed by third-party payment providers (Stripe and/or PayPal). By making a donation, you also agree to the applicable payment provider's terms of service. We do not store your full credit card number on our servers.


6. Acceptable Use

You agree to use the Site only for lawful purposes and in a manner consistent with these terms. You may:

  • Access the Site to learn about the Tooele County Republican Party and its activities.
  • Create an account and manage your profile, preferences, and privacy settings.
  • Register for events, volunteer for opportunities, and participate in party activities.
  • Make political contributions in compliance with applicable law.
  • Engage respectfully with other members and the community.

7. Prohibited Conduct

You agree not to engage in any of the following:

7.1 Security Violations

  • Attempting to gain unauthorized access to any part of the Site, other users' accounts, or our systems (including databases, servers, and networks).
  • Circumventing security measures, including authentication, access controls, or rate limiting.
  • Distributing malware, viruses, or other harmful code through or to the Site.
  • Scraping, crawling, or automated data collection from the Site without prior written authorization.
  • Attempting to disrupt or degrade the Site's availability or performance.

7.2 Legal Violations

  • Voter intimidation — Intimidating, threatening, or coercing any person to influence their vote or political participation. Voter intimidation is a federal crime under 18 U.S.C. § 594 and a state offense under Utah Code § 20A-3a-504.
  • Fraudulent contributions — Making contributions in the name of another person, using funds provided by another person or entity, or making contributions as a foreign national. These are federal crimes under 52 U.S.C. § 30122 and § 30121.
  • Misuse of contributor data — Using FEC-reported contributor information to solicit contributions or for commercial purposes is prohibited under federal law (52 U.S.C. § 30111(a)(4)).
  • Posting, uploading, or transmitting any content that is illegal under federal, state, or local law.
  • Impersonating any person, organization, or government official.
  • Defamation — Knowingly publishing false statements of fact that damage another person's reputation.

7.3 Community Standards

  • Harassment, bullying, or threats directed at any person, including other members, volunteers, staff, elected officials, or members of the public.
  • Posting content that incites violence or physical harm against any individual or group.
  • Spam — Sending unsolicited or repetitive messages, or posting irrelevant content.
  • Misrepresenting your identity, qualifications, or affiliations.

8. Event Participation

8.1 Registration and Attendance

When you register for an event, you agree to:

  • Provide accurate registration information.
  • Comply with the event's code of conduct and any venue-specific rules.
  • Arrive on time and behave respectfully toward other attendees, speakers, and staff.

8.2 Photography and Recording

Events may be photographed or recorded for promotional, archival, or news purposes. By attending a party event, you consent to the use of your likeness in photographs and recordings taken at the event, unless you notify event organizers in advance of your objection.

8.3 Assumption of Risk

You acknowledge that participation in events involves inherent risks, including but not limited to risks associated with travel, weather, physical activity, and interaction with others. You voluntarily assume these risks by attending.

8.4 Right to Refuse Entry

The Tooele County Republican Party reserves the right to refuse entry to or remove any person from an event for any reason, including but not limited to violations of the code of conduct, disruptive behavior, safety concerns, or active ban status. No refund of event fees (if applicable) is guaranteed in such circumstances.

8.5 Event Cancellation

We reserve the right to cancel, reschedule, or modify events at our discretion. If a paid event is cancelled by us, we will offer a refund or credit for the ticket price.

8.6 Third-Party Venues

Events may be held at venues not owned or operated by the Tooele County Republican Party. We are not responsible for conditions, policies, or incidents at third-party venues.

8.7 Waitlist

If an event reaches capacity, you may be placed on a waitlist. If a spot becomes available, you will be notified via your preferred notification channel. Placement on a waitlist does not guarantee admission.


9. Volunteer Terms

9.1 Volunteer Status

Volunteering with the Tooele County Republican Party is not employment. Volunteers do not receive compensation, wages, or benefits. No employer-employee relationship is created by volunteering.

9.2 Expectations

As a volunteer, you agree to:

  • Perform your duties with honesty and good faith.
  • Follow instructions from party staff and event coordinators.
  • Adhere to the party's code of conduct and these Terms of Use.
  • Protect any confidential information you may access in the course of volunteering.

9.3 Assumption of Risk and Release

You acknowledge that volunteer activities may involve physical activity, travel, outdoor work, interaction with the public, and other risks. You voluntarily assume these risks and release the Tooele County Republican Party, its officers, staff, and agents from liability for injuries or damages arising from volunteer activities, except in cases of gross negligence or intentional misconduct.

9.4 Termination of Volunteer Relationship

Either party may end the volunteer relationship at any time, for any reason, without notice. The Tooele County Republican Party may remove a volunteer from assignments or revoke volunteer status for violations of these terms, the code of conduct, or for any other reason at its discretion.

9.5 Annual Confirmation

Active volunteers are required to reconfirm their participation annually. If you do not respond to a confirmation request within the specified period, your volunteer status may be changed to inactive.


10. User Content

10.1 Your Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of any content you submit to the Site, including profile information, event registration notes, volunteer applications, and contact form messages.

10.2 License Grant

By submitting content to the Site, you grant the Tooele County Republican Party a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content for party operations, including but not limited to internal communications, event coordination, and promotional purposes.

10.3 Content Moderation

We reserve the right to review, edit, or remove any user-submitted content at our discretion, including content that violates these terms or that we deem inappropriate. As a private political organization, we are under no obligation to host, publish, or promote all viewpoints.

10.4 Intellectual Property Claims

If you believe that content on the Site infringes your intellectual property rights, please notify us through our Contact page with a description of the allegedly infringing material, the intellectual property right you believe is infringed, and your contact information. We will investigate and respond to valid claims.


11. Account Suspension and Termination

11.1 Grounds for Action

We may suspend, restrict, or terminate your account if you:

  • Violate these Terms of Use or our Privacy Policy.
  • Engage in prohibited conduct as described in Section 7.
  • Pose a safety risk to other users, staff, or the public.
  • Provide false or misleading information.
  • Engage in conduct that brings the party into disrepute.

11.2 Ban Types

Account restrictions may include:

  • Account ban — Full suspension of your account and access to authenticated features.
  • Event ban — Restriction from registering for or attending party events.
  • Comment ban — Restriction from posting or submitting content.

Bans may be temporary (with a specified expiration date) or permanent.

11.3 Notification and Appeal

If your account is subject to moderation action, you will be notified of the action taken and the reason for it. You may appeal a ban by contacting us through our Contact page. Appeals will be reviewed by party administrators, and decisions are at our sole discretion.

11.4 Effect on Donations

Donations are not refundable upon account termination. Political contributions are made to the party committee, not in exchange for account access or services.

11.5 Data After Termination

Upon account termination, your personal data will be handled in accordance with our Privacy Policy, including applicable retention requirements (such as FEC donation records).


12. Intellectual Property

12.1 Site Content

The content, design, graphics, logos, and other materials on the Site are the property of the Tooele County Republican Party or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

12.2 Your License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purposes, subject to these Terms of Use. This license does not include the right to:

  • Use the Republican Party name, logos, or trademarks without authorization.
  • Download, copy, or redistribute Site content for commercial purposes.
  • Use the Site or its content to create competing products or services.

13. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources. These links are provided for convenience only.

  • We are not responsible for the content, accuracy, privacy practices, or availability of third-party sites.
  • Your use of third-party services (including Stripe, PayPal, and social media platforms) is governed by those services' own terms and privacy policies.
  • A link to a third-party site does not imply our endorsement of that site or its content.

14. Disclaimer of Warranties

THE SITE AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Accuracy and completeness — We do not warrant that information on the Site is accurate, complete, or current.
  • Availability — We do not guarantee uninterrupted or error-free access to the Site.
  • Election outcomes — Nothing on this Site constitutes a guarantee or prediction of any election result.
  • Professional advice — Content on the Site is not legal, tax, financial, or professional advice. Consult qualified professionals for such matters.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOOELE COUNTY REPUBLICAN PARTY, ITS OFFICERS, STAFF, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • Your use of or inability to use the Site.
  • Any user-submitted content.
  • Actions of third parties, including other users.
  • Incidents at events covered by assumption-of-risk provisions.
  • Service interruptions, data loss, or security breaches beyond our reasonable control.
  • Election results or political outcomes.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.


16. Indemnification

You agree to indemnify, defend, and hold harmless the Tooele County Republican Party, its officers, staff, volunteers, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to:

  • Your violation of these Terms of Use.
  • Your use of the Site.
  • Content you submit to the Site.
  • Your violation of any law or regulation.
  • Your infringement of any third party's rights.

17. Governing Law and Disputes

17.1 Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.

17.2 Jurisdiction

Any legal action or proceeding arising from these terms shall be brought exclusively in the state or federal courts located in Tooele County, Utah, and you consent to the personal jurisdiction of such courts.

17.3 Informal Resolution

Before filing any formal legal proceeding, you agree to attempt to resolve any dispute informally by contacting us through our Contact page. We will attempt to resolve the dispute informally within 30 days.

17.4 Statute of Limitations

Any claim arising from these Terms of Use or your use of the Site must be filed within one (1) year after the cause of action arises, or it is permanently barred.


18. General Provisions

18.1 Severability

If any provision of these Terms of Use is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

18.2 Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and the Tooele County Republican Party regarding your use of the Site, and supersede all prior agreements and understandings.

18.3 No Waiver

Our failure to enforce any provision of these terms does not constitute a waiver of that provision or our right to enforce it in the future.

18.4 Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations without restriction.
